LEGAL SCOPE

Section 2 of Article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the General Data Protection Regulation (hereinafter, GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (hereinafter, LOPDGDD), establishes that:

  • Service providers may use data storage and retrieval devices on recipients’ terminal equipment, provided that they have given their consent after being provided with clear and comprehensive information about their use, particularly regarding the purposes of data processing, in accordance with the provisions of the Personal Data Protection regulations.
  • Where technically possible and effective, the recipient’s consent to the processing of data may be provided by using appropriate parameters of the browser or other applications.
  • The above shall not prevent technical storage or access for the sole purpose of transmitting a communication over an electronic communications network or, to the extent strictly necessary, for the provision of an information society service explicitly requested by the recipient.

The GDPR, in its recital 30, mentions these technologies and their impact on data protection, stating that individuals may be associated with online identifiers provided by their devices, applications, tools, and protocols, such as internet protocol addresses, session identifiers in the form of “cookies,” or other identifiers such as radio frequency identification tags. This can leave traces that, when combined with unique identifiers and other data received by servers, can be used to create profiles of individuals and identify them.

This cookie policy has been revised in accordance with the new cookie usage rules published by the Spanish Data Protection Agency (AEPD) on July 28, 2020, amending the Guide on the use of cookies to adapt it to the Guidelines on consent modified in May 2020 by the European Data Protection Committee (EDPC) (Guidelines 05/2020) on consent. Specifically, technical measures have been taken to ensure that the “continue browsing” option is not configured as an option to obtain consent, and that “cookie walls” are not implemented.

WHAT IS A COOKIE

According to the expiration date, the used cookies may have the following types of expiration:

Session cookies: those designed to collect and store data while the user accesses a website. They are usually used to store information that is only of interest to keep for the provision of the service requested by the user on a single occasion (e.g., a list of purchased products) and disappear at the end of the session.
